Agricultural Industry Services Regulation 2009

The Agricultural Industry Services Regulation 2009 commenced on 1 September 2009 (online notification on 28 August 2009).

The Regulation was made under the Agricultural Industry Services Act 1998. The Act provides for the establishment of agricultural industry service committees to perform particular services for specified classes of primary producers and for primary products grown, raised, produced, packed, processed or marketed within defined geographical areas in NSW.

The Regulation is an amalgamation of the Agricultural Industry Services (Wine Grapes Marketing Board) Regulation 2003, the Agricultural Industry Services (Interstate Arrangements) Regulation 2004 and the Agricultural Industry Services (Polls and Elections) Regulation 2005.

It was originally intended to amalgamate a fourth regulation, the Agricultural Industry Services (Riverina Citrus) Regulation 2007, and this Regulation was included in the discussion in the regulatory impact statement (RIS). It was subsequently decided to keep the Regulation independent of the combined Agricultural Industry Services Regulation 2009.

The Agricultural Industry Services Regulation 2009 gives effect to the Act by establishing an agricultural industry services committee, the Wine Grapes Marketing Board and by prescribing the requirements for holding polls and elections for agricultural committees. The Regulation also gives recognition to two Orders made under the Victorian Agricultural Industry Development Act 1990 as foundation instruments for the purposes of the Act and provides for the Orders to apply to specific regions in NSW.

The draft Regulation and RIS were released for public consultation on 18 May 2009. The public consultation period closed on 15 June 2009. One response was received, which supported the proposed Regulation.
