Timber Marketing Regulation 2010
The Timber Marketing Regulation 2005 was subject to staged repeal on 1 September 2010 as required under the Subordinate Legislation Act 1989. Under this Act, most regulations are subject to automatic repeal every five years. This process generally involves reviewing the Regulation and determining whether to allow the Regulation to lapse or be remade with or without amendment.
The Timber Marketing Regulation 2010 commenced on 1 September 2010 after online notification on the NSW Legislation website on 27 August 2010. The Regulation is made under the Timber Marketing Act 1977. The object of the Act is to ensure that the quality of timber sold in the marketplace is fit for purpose. The Regulation prescribes the tests and results for lyctid susceptible sapwood, and for assessing the moisture content of timber. It also prescribes procedures and standards for preservative treatment of timber, and official forms and notices ensuring that minimum timber quality requirements are met.
The draft Regulation and Regulatory Impact Statement (RIS) (169kb PDF) were placed on public consultation from 30 June 2010 to 27 July 2010. Three submissions were received. A report on the outcomes of the public consultation (72kb PDF) provides an update on the submissions received and the changes made to the draft Regulation as a result.
The final Regulation can be viewed on the NSW Legislation website of the NSW Parliamentary Counsel at www.legislation.nsw.gov.au.
