General mine safety legislation (applies to all NSW mines)
Mines safety legislation (metalliferous, extractives and opal mines)
The principal mine safety Acts which apply to NSW mines are:
- Occupational Health and Safety Act 2000
- Coal Mine Health and Safety Act 2002
- Mine Health and Safety Act 2004
- Explosives Act 2003
These Acts and their supporting regulations set out requirements for ensuring that NSW mines are safe and healthy. These requirements spell out the duties of different groups of people who play a role in workplace health and safety. Where a conflict arises the Occupational Health and Safety Act 2000 prevails.
National review into model OHS laws
Two reports into the National review of model OHS laws by the National OHS Review Panel have been released. The reports address key issues such as duties of care, offences and defences.
