The principal mine safety Acts which apply to NSW mines are:
- NSW Work Health and Safety Act 2011
- Coal Mine Health and Safety Act 2002
- Mine Health and Safety Act 2004
- Explosives Act 2003
Legislation prior to 1 January 2012
Prior to the implementation of the NSW Work Health and Safety Act 2011, the NSW Occupational Health and Safety Act 2000 applied to NSW mines.

These Acts and their supporting regulations set out requirements for ensuring that NSW mines are safe and healthy. These requirements spell out the duties of different groups of people who play a role in workplace health and safety. Where a conflict arises the Work Health and Safety Act 2011 prevails.
