Coal mines safety legislation
The commencement of the Coal Mine Health and Safety Act 2002 and Coal Mine Health and Safety Regulation 2006 on 23 December 2006 repeals the Coal Mines Regulation Act 1982. The development of the CMHS Act and CMHS Regulation provides closer alignment with the Occupational Health and Safety Act 2000 and Occupational Health and Safety Regulation 2001.

OHS Regulation and the coal sector
The Occupational Health and Safety Regulation 2001 is being extended from 1 September 2008 to apply to the NSW mining industry, including the coal sector. For further information on how the OHS Regulation applies to the coal sector, click here.

Contact details of coal operators are available on request at NSW DPI offices in regions where coal is mined.

Register of exemptions under CMHS Regulation Clause 202
Details of temporary exemptions granted under Clause 202 of the Coal Mine Health and Safety Regulation 2006 are available on request at NSW DPI offices in regions where coal is mined.
