Titles

Times at which applications can formally be received

Mining Regulation 2003

Applications for exploration and mining titles may be made in a number of ways in NSW. To assist potential applicants in selecting a lodgement method, the tables below outline the times at which applications are formally received. Formal application receipt times are determined in accordance with Clause 56 of the Mining Regulation 2003.

Applications where NO fee is required (Clause 56 (4-8)).

Online (only for exploration licences (ELs) for Groups 1 to 8 Group 10 minerals)

At the time the online application is concluded. Online EL applications require payment of the fee by credit card as part of the lodgement process. Following completion of a successful online application, the system will generate an application number and time and date the application was received. This information can be printed before exiting the system.

Online applications can be lodged at any time.

Applicants who provide an email contact, receive an automatic confirmation of the time, date, and ELA number, following completion of a successful application.

Mail

At the time and date of payment of the fee or at 9.30am on the day on which the application is received, whichever is later.

Personal applications will be received between 9.30am and 4.00pm Mon-Fri excluding public holidays.

Fax

At the time and date of payment of the fee or at the time and date that the application’s receipt is recorded, whichever is later.

In Person

At the time the application is recorded as having been received by the delegated receiving officer.

Email

At the time and date of payment of the fee or at the time and date that the application is allocated an exploration licence application number by the Titles Administration System, whichever is later.

Note: There is a 5 MB size limit for lodgement by email.

Additional Information:

Should an application be lodged in person before 9.30am Mon-Friday (excluding public holidays), the actual receipt time will be 9.30am on that day. Similarly if an application is lodged in person after 4.00pm the application will officially be received at 9.30am the following working day.

In the case of lodgement of an application by facsimile where a fee is payable and a credit card is used to pay the fee, the earliest time an application can officially be received is 8.30am (Mon-Fri excluding public holidays). If the incoming facsimile machine records the application as being received after 4.30pm, the application will be received after 8.30am on the following working day.

If payment is made by the direct debit method of payment, and evidence of the deposit is supported with the facsimile application, the official receipt time is the date and time recorded by the receiving facsimile machine.

If lodging an application requiring a fee by any method other than online, it is advisable to use the direct debit method of payment, and attach the evidence with your application. This will ensure the application is formally received at the earliest possible time.

Mineral Claim applications must be lodged with the Mining Registrar of the Division to which the claim is located.

Petroleum (Onshore} Act 1991

Applications are received in accordance with Section 11 of the Petroleum (Onshore) Act 1991. Applications for petroleum titles must be delivered or forwarded by post to the Director-General.
