Transfer of the Mining Warden's jurisdiction to the Land and Environment Court
On 7 April 2009 the Mining Warden's jurisdiction was transferred to the NSW Land and Environment Court, where mining matters will now be designated as Class 8 proceedings. Mining Warden Functions retained by DPI
Certain functions previously undertaken by the Warden however, have been retained by the Director-General or Minister for Mineral Resources:
Mining Act 1992
Such matters include those relating to the lodgement of objections under the provisions of the Mining Act 1992, whereby such objections must be taken into consideration by the Minister when determining applications, amongst other things.

Petroleum (Onshore) Act 1991
Such matters include those relating to the payment of compensation by the Minister for any loss or damage caused by any person exercising any powers to enter premises, amongst other things.
