Standard permit conditions
Standard conditions for land based permits (STDFARM)
- The permit holder must only dispose of dead or diseased fish or marine vegetation at a facility licensed as a waste management facility under the Protection of the Environment Operations Act 1997, or disposed of ‘on-farm’ such that the disposal method does not significantly adversely affect groundwater or local amenity.
- The permit holder must maintain a record of all sales and disposals of fish or marine vegetation for a period of five years from the date of sale or disposal of the fish or marine vegetation. A copy of the sales record must be provided to the purchaser or recipient of the fish or marine vegetation. The sales record must be written legibly in English and include:
- The full name and address of the seller including ABN or ACN and any registered trading name;
- The aquaculture permit number under which the fish or marine vegetation were cultivated;
- The date of the sale or disposal;
- The name, weight or number and total value of each species of fish or marine vegetation sold or disposed;
- A unique sequential identifying number allocated to the sale or disposal for the purposes of the record; and
- In respect to the sale or disposal of live fish the record must include the name (including the registered trading name if applicable) and address of the consignee or person, business or company taking possession of the fish.
Specific permit conditions
Land-based without protocols
Class E permit (CLASSE)
- The permit holder may only stock ponds with progeny produced from endemic broodstock.
- The permit holder must ensure that no more than 100 yabby traps are used at any one time to undertake collection activities.
- The permit holder must ensure that all yabby traps used under the authority of the permit do not exceed 1 metre in length, 0.6 metre in width and 0.3 metre in depth; are constructed of netting or mesh (not being rigid mesh, such as metal or hard plastic) not less than 13 mm along the longest diagonal; have entrance funnel or funnels containing a rigid ring with a maximum internal diameter of 90 mm permanently affixed at some point along the funnel or funnels; and a non-removable plastic tag, marked legibly with the permit number, must be attached to each trap.
- The permit holder must ensure that supplementary feed is not added to any waters in the area within which the holder is authorised to undertake aquaculture.
- The permit holder must ensure that no berried females or soft shelled yabbies are taken from the area within which the holder is authorised to undertake aquaculture.
Freshwater discharge from facility (FWDISC)
- The permit holder must ensure that all discharge in relation to aquaculture is only discharged into waters in the area within which the permit holder is authorised to undertake aquaculture, unless otherwise authorised by licence under Section 55 of the Protection of the Environment Operations Act 1997 or Trade Waste Agreement.
Import Golden Perch from QLD (GPQLD)
- The permit holder must ensure that Golden Perch broodstock imported from Queensland to the area within which the permit holder is authorised to undertake aquaculture are held in isolation (quarantine) from all other fish and waters on the area for two weeks from the time of arrival at the area.
- If any infections, mortalities or adverse health issues occur during the abovementioned two week quarantine period the permit holder must as soon as practicable report the infection, mortalities or adverse health issues to the department and ensure that the fish are not moved from quarantine.
- The permit holder must ensure that all transport and effluent water from the quarantine facility that contains the Golden Perch broodstock imported from Queensland is retained and treated with chlorine (200 ppt) for 24 hours prior to discharge.
- The permit holder must not release Golden Perch broodstock imported from Queensland or their progeny into NSW waters other than waters in the area within which the permit holder is authorised to undertake aquaculture.
- The permit holder must ensure that all Golden Perch broodstock imported from Queensland are sold dead.
Import live feed into NSW (LVEFD)
- The permit holder must not import live feed into NSW, with the exemption of commercially cultured algae, Rotifers and Artemia, from interstate unless specified in a special condition attached to this permit.
Cultivation of Marron or Redclaw (MARRED)
- The permit holder must ensure that all aquaculture production facilities used to culture Marron (Cherax tenuimanus) or Redclaw (Cherax quadricarinatus) are enclosed within a fence like structure that prevents the escape of these fish. The fence must extend at least 60cm above the surface of the ground and must extend at least 30cm beneath the surface of the ground. The fence must be constructed of a material that has a smooth surface that freshwater crayfish cannot climb (e.g. plastic sheeting or galvanised iron).
Operation of marine bivalve hatchery (Class H) (CLHOYS)
- The permit holder may only sell triploid Pacific Oyster spat to the holder of a Class A Aquaculture Permit that authorises the cultivation of triploid Pacific Oysters.
- Where the permit holder supplies batches of triploid Pacific Oyster spat that are to be on-grown in waters other than Port Stephens, the permit holder must provide with each batch a copy of certification report indicating that the batch is 100% triploid.
Triploid Pacific Oyster in hatchery (Class H) (CLHTPO)
- The permit holder may only sell triploid Pacific Oyster spat to the holder of a Class A Aquaculture Permit that authorises the cultivation of triploid Pacific Oysters.
- Where the permit holder supplies batches of triploid Pacific Oyster spat that are to be on-grown in waters other than Port Stephens, the permit holder must provide with each batch a copy of certification report indicating that the batch is 100% triploid.
Cultivation of Yabbies (YABBY)
- The permit holder may sell the progeny of Yabbies that spawn naturally in ponds in the area within which the permit holder is authorised to undertake aquaculture without contravening Standard Condition 3 (STDALL3) of this Schedule.
Cultivation of Akoya Oyster under land based permit (AKOOYSLND)
- The permit holder is not authorised to cultivate seeded Akoya Oysters and is not authorised to produce pearls.
Land based with protocols
Importation of Barramundi (BARIMP)
- For the purposes of section 216 of the Fisheries Management Act 1994, the permit holder is authorised to place into the area(s) authorised by this permit Barramundi (Lates calcarifer) that has been imported under the provisions specified in the Protocol for Health Certification of Barramundi Fingerlings for Aquaculture, prior to entry into NSW (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
- The permit holder is not authorised to import from interstate Barramundi (Lates calcarifer) unless in accordance with an approved section 217 import permit.
Cultivation of Cobia (COBIA)
- The permit holder may only keep or cultivate Cobia (Rachycentron canadum) that have been sourced from an area outside NSW if they have been sourced in accordance with the “Protocol for the importation of Cobia (Rachycentron canadum) into NSW” (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Cultivation of Flowery Cod (FLWCOD)
- The permit holder may only keep or cultivate Flowery Cod (Epinephelus fuscoguttatus) that have been sourced from an area outside NSW if they have been sourced in accordance with the “Protocol for the importation of Flowery Cod (Epinephelus fuscoguttatus) into NSW” (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Cultivation of Marine Polycheate (MARPOL)
- The permit holder may only keep or cultivate Marine Polychaete Worms (Perinereis helleri) that have been sourced from an area outside NSW if they have been sourced in accordance with the “Protocol for the importation of Marine Polychaete Worm (Perinereis helleri) into NSW” (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Cultivation of native freshwater finfish (NATFIN)
- The permit holder may only keep or cultivate native freshwater finfish fingerlings that have been sourced from outside NSW if they have been sourced:
- in accordance with the Protocol for the translocation of all native freshwater finfish juveniles (excluding Lates calcarifer) – Qld and NSW Governments (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols), and/or
- in accordance with an approved Section 217 Importation Permit.
Prawn Broodstock for NSW farms (PRWNSW)
- The permit holder may only keep or cultivate marine prawn species that have been sourced from outside NSW if they have been sourced in accordance with the Health protocol for the translocation of prawn broodstock into NSW and production of post–larvae for stocking into NSW prawn farms for the 2020 season (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Translocation of prawns into NSW (PRWIMP)
- The permit holder must only keep or cultivate Black Tiger Prawn (Penaeus monodon) that have been sourced from outside or within NSW if they have been sourced in line with the Health protocol for the translocation of prawns into NSW prawn farms (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
- The permit holder must only keep or cultivate prawn species other than Black Tiger Prawn (Penaeus monodon) that have been sourced from within NSW if they have been sourced in line with the Health protocol for the translocation of prawns into NSW prawn farms (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
- The permit holder must not source any prawn species other than Black Tiger Prawn (Penaeus monodon) from interstate.
- In line with section 216 of the Fisheries Management Act 1994, the permit holder is authorised to place into the area(s) authorised by this permit, Black Tiger Prawn (Penaeus monodon) that has been imported from interstate under the provisions specified in the Health protocol for the translocation of prawns into NSW prawn farms (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Import Sydney Rock Oysters from WA Class C permit (SRWACLC)
- For the purposes of section 216(1) of the Fisheries Management Act 1994, the permit holder is authorised to place onto the area authorised by this permit, Sydney Rock Oyster spat produced by Western Australian Shellfish Hatchery Pty Ltd under the provisions specified in the Shellfish Hatchery Protocol - Production and Translocation into NSW of Sydney Rock Oyster (Saccostrea glomerata) spat produced by Western Australian Shellfish Hatchery Pty Ltd, Western Australia (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Import Sydney Rock Oysters from QLD Class C permit (SROQLDCLC)
- For the purposes of section 216(1) of the Fisheries Management Act 1994, the permit holder is authorised to place onto the area authorised by this permit, Sydney Rock Oyster spat produced by Victorian Shellfish Hatchery Pty Ltd under the provisions specified in the Shellfish Hatchery Protocol – Production and Translocation into NSW Waters of Sydney Rock Oyster (Saccostrea glomerata) spat produced by Victorian Shellfish Hatchery Pty Ltd. 2A Bellarine Hwy, Queenscliff Vic, 3225 (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Import Sydney Rock Oysters from VIC Class C Permit (SROVICCLC)
- For the purposes of section 216(1) of the Fisheries Management Act 1994, the permit holder is authorised to place onto the area authorised by this permit, Sydney Rock Oysters produced by AquaFarms Queensland Pty Ltd, under the provisions specified in the Shellfish Hatchery Protocol – Production and Translocation into NSW of Sydney Rock Oyster (Saccostrea glomerata) spat produced by AquaFarms Queensland Pty Ltd, Queensland (refer to www.dpi.nsw.gov.au/fishing/aquaculture/publications/general/aquaculture-permit-protocols).
Import Sydney Rock Oysters from interstate (SROIMPLAND)
For the purposes of Section 216(1) of the Fisheries Management Act 1994, the permit holder is authorised to place onto the areas authorised by this permit, Sydney Rock Oyster spat produced by an authorised hatchery, under the provisions of the following protocols, which are available at www.dpi.nsw.gov.au/dpi/fishing/aquaculture/aquaculture-protocols:
- Shellfish Hatchery Protocol – Production and translocation into NSW of Sydney Rock Oyster (Saccostrea glomerata) spat produced by AquaFarms Queensland Pty Ltd, Queensland.
