Shellfish App - Oyster Shipments - Privacy Collection Notice


The Department of Regional NSW (DRNSW) (of which NSW Department of Primary Industries (NSW DPI) is a part) gives priority to protecting the privacy of your personal information.

In completing this form, you will be providing personal information from your aquaculture permit holder account (including your name and email address) to NSW DPI. You are required by the Fisheries Management Act 1994 (FM Act) to complete this form before moving oysters, catching material, cultivation material or other infrastructure between specified NSW estuaries.  This form is an approved form of the Oyster Shipment Log Book prescribed by the regulations made under the FM Act.

The information you provide in this form will be used by NSW DPI (including DPI Biosecurity and DPI Fisheries) to:

  • conserve, develop and share the fisheries resources of NSW, including promoting viable aquaculture industries
  • ensure compliance with aquaculture regulatory controls,
  • ensure compliance with aquaculture permit requirements, and
  • issue you with an aquaculture permit allowing the movement of oysters, cultivation equipment and cultivation materials between estuaries.

NSW DPI will also use information you provide to:

  • perform biosecurity risk functions under the Biosecurity Act 2015 (Biosecurity Act),
  • obtain information or records for purposes connected with the administration of the Biosecurity Act, regulations and BOPA,
  • carry out research into the prevention, elimination and minimisation of biosecurity risks posed by biosecurity matter,
  • promote biosecurity as a shared responsibility between government, industry and communities, including advising you of programs to prevent, eliminate and minimise biosecurity risks,
  • meet the biosecurity requirements of other jurisdictions and give effect to intergovernmental biosecurity agreements, and
  • pay compensation under the Biosecurity Act.

Other ways NSW DPI may use your personal information include:

  • responding to and managing any enquiries and complaints
  • obtaining feedback about the effectiveness of NSW DPI’s services.

NSW DPI may disclose information to third parties including Local Land Services, Environmental Protection Agency, local councils and interstate biosecurity counterparts and other public sector agencies where permitted by law. The information collected may be used in the event of a biosecurity response to facilitate tracing and containment of biosecurity matter and to support management of biosecurity risks specific to oysters.

NSW DPI will not disclose personal information about you to any person except where required to fulfil the purpose for which you are providing the information, or where permitted by law.  Inc some circumstances, the law authorises DRNSW, authorised officers and other persons engaged in the administration of the Biosecurity Act to disclose your personal information, including to public sector agencies and to other persons.

Anyone engaged to collect, store or use personal information for DRNSW will be required to comply with the Information Protection Principles of the Privacy and Personal Information Protection Act 1998 as part of their terms of engagement.
